Read thru the articles as guidelines for promotional materials.

Reference Article V, Section 2(b), – (c) and – (d) of the Implementing Rules and Regulation of Republic Act No. 9711 and Article 112(a), – (b) of Republic Act 7394 or the Consumer Act of the Philippines, which provides that:

  • IRR of RA 9711, Book II, Article V, Section 2(b)
    “No claim in the advertisement, promotion and sponsorship, and other marketing activities shall be made other than those contained in the approved label of packaging of the health product, or as duly approved by the FDA”
  • IRR of RA 9711, Book II, Article V, Section 2(c)
    “No claims, therapeutic or scientific otherwise, shall be made that has not been duly approved by the FDA”
  • IRR of RA 9711, Book II, Article V, Section 2(d)
    “All health products that are permitted to be promoted must specifically state the authority or reference number that approved the same promotional, sponsorship, or marketing activities”
  • RA 7394, Article 112(a)
    “No claim in the advertisement may be made which is not contained in the label or approved by the concerned department.”
  • RA 7394, Article 112(b)
    “No person shall advertise any food, drug, cosmetic, device or hazardous substance in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character value, composition, merit or safety.”
